You Have Received a Misconduct Notice — Reg 17 Explained
A Regulation 17 written notice formally tells you that a matter is being investigated as potential misconduct or gross misconduct. The notice triggers specific rights and timeframes. Read it carefully and engage your Federation immediately.

Who this guide is for
- Officers served with a Reg 17 notice
- Officers under formal misconduct investigation
- Supervisors signposting team members
What to do first
Read the notice carefully and immediately contact your Federation representative. Acknowledge receipt in writing through them. Make a private contemporaneous note of your account.
Step-by-step guide
- 1
Read the notice in full
It must state the conduct in question, the standards alleged to have been breached, the severity assessment (misconduct or gross misconduct), and your rights to representation and to respond.
- 2
Contact your Federation rep within 24 hours
The notice does not bar you from working but does start a formal clock. Your rep will review wording, severity, and next steps.
- 3
Acknowledge receipt
Acknowledge in writing through your rep. Do not respond substantively until legal review.
- 4
Request the investigation plan and timeline
You are entitled to know the scope, the investigator, and indicative timeframe. Push back politely if unclear.
- 5
Prepare your written response
With your rep and (for gross misconduct) a solicitor, draft a structured response addressing each allegation. Stick to facts; avoid emotional language.
Your rights
- Right to written notice of allegations and standards in question
- Right to know the severity assessment
- Right to Federation representation throughout
- Right to a reasonable response timeframe
- Right to be interviewed with rep present
- Right to make written representations before any meeting
Common pitfalls to avoid
- Responding emotionally or in writing before rep review
- Missing the deadline because the notice was ignored
- Discussing the case in WhatsApp groups
- Assuming the matter will quietly go away
- Failing to ask for clarification of vague allegations
When to get help
Federation rep is automatic. If the severity assessment is gross misconduct, a solicitor will usually be arranged through the Federation. Occupational health support is available throughout — use it.
